Charter Booking & Reservations **2.1 Booking Confirmation** A charter reservation is confirmed only after you have spoken with Captain Damian and received written or verbal confirmation of your booking date, trip type, and pricing. Submitting a contact form does not guarantee a reservation. **2.2 Group Size** Standard charter trips accommodate up to 4 anglers. The vessel has a maximum capacity of 6 anglers. Groups of 5-6 must contact us directly to confirm availability and pricing. All passengers must be accounted for at the time of booking. **2.3 Pricing** All trips are priced for the entire boat — not per person. Current pricing: - Half Day Offshore (4 hours) — $850 - 3/4 Day Offshore (6 hours) — $1,150 Prices are subject to change. The price confirmed at the time of booking is the price you will pay. **2.4 Payment** Payment terms will be communicated at the time of booking. We accept cash and major credit cards. Cancellation & Refund Policy **3.1 Guest Cancellations** - Cancellations made with **3 or more days notice** — full refund or free rescheduling - Cancellations made with **less than 3 days notice** — deposit may be forfeited - No-shows without notice — full trip amount may be charged **3.2 Weather Cancellations** Captain Damian Picciano reserves the right to cancel or reschedule any trip due to unsafe weather or sea conditions. Safety is always the priority. In the event of a weather cancellation initiated by the captain: - Full refund will be issued, OR - Trip will be rescheduled at no additional charge - The captain's determination of unsafe conditions is final **3.3 Rescheduling** We will make every reasonable effort to reschedule cancelled trips based on availability. Rescheduled trips are subject to current availability and cannot be guaranteed on specific dates. --- ## 4. Assumption of Risk & Liability Waiver **4.1 Assumption of Risk** Offshore fishing involves inherent risks including but not limited to: rough sea conditions, weather changes, physical exertion, exposure to sun and heat, fish hooks and sharp equipment, and the motion of a vessel on open water. By booking a charter with Siesta Key Sport Fishing Charters, you acknowledge and voluntarily assume all such risks. **4.2 Limitation of Liability** To the maximum extent permitted by applicable law, Siesta Key Sport Fishing Charters, Captain Damian Picciano, and any crew members shall not be liable for any injury, illness, loss, damage, or death arising from participation in any charter trip, except in cases of gross negligence or willful misconduct. **4.3 Personal Property** We are not responsible for lost, stolen, or damaged personal property during a charter trip. Bring only what you need and secure valuables appropriately. **4.4 Medical Conditions** Guests with medical conditions — including but not limited to heart conditions, back or neck injuries, pregnancy, or motion sickness — should consult a physician before booking an offshore fishing charter. Conduct on Board **5.1 Captain's Authority** Captain Damian Picciano has full authority over all decisions on board including navigation, fishing locations, safety procedures, and trip duration. His decisions are final. **5.2 Guest Conduct** All guests are expected to behave in a safe, respectful, and cooperative manner. Captain Damian reserves the right to terminate a trip early and return to the dock without refund if any guest: - Is intoxicated or under the influence of illegal substances - Behaves in a threatening, abusive, or disruptive manner - Refuses to follow safety instructions - Endangers the safety of themselves or others on board **5.3 Alcohol** Guests may bring alcohol on board in reasonable quantities. Excessive consumption that compromises safety or conduct will result in early trip termination without refund. **5.4 Seasickness** We are not responsible for seasickness or discomfort caused by sea conditions. No refunds are issued for seasickness. Over-the-counter seasickness medication is strongly recommended for guests prone to motion sickness. --- ## 6. Fishing Regulations & Licensing **6.1 Fishing License** A Florida saltwater fishing license is included in the price of every charter trip. Guests are covered under the vessel's charter license and do not need to purchase individual licenses. **6.2 Fishing Regulations** All fishing is conducted in accordance with Florida Fish and Wildlife Conservation Commission (FWC) regulations and federal regulations where applicable. Bag limits, size limits, and seasonal closures will be strictly followed. Captain Damian's determination of legal catch is final. **6.3 Catch** Guests keep their legal catch. Fish cleaning and filleting is included at no extra charge. We are not responsible for fish after they leave the vessel. --- ## 7. Departure & Timing **7.1 Departure Time** Guests must arrive at the dock at least 15 minutes before scheduled departure. Trips depart at the scheduled time. Actual fishing time may vary based on travel time to fishing grounds, weather conditions, and fish activity. Captain Damian will make every effort to maximize productive fishing time within the scheduled trip window. **7.3 Location** Exact dock and departure location will be confirmed at the time of booking.
